ITC SPELLS TROUBLE FOR M&M

A US regulator ruled that India’s Mahindra and Mahindra Ltd infringed Fiat Chrysler Automobiles NV’s (FCA) Jeep brand’s intellectual property rights, barring the selling of the vehicles involved.

The International Trade Commission, in a decision released late Thursday, issued a limited exclusion order prohibiting sale or import of the infringing vehicles and parts, as well as a cease and desist order to Mahindra and its North American unit. According to the the ITC, Mahindra’s Roxor off-road utility vehicle violated the “trade dress” of FCA’s Jeep Wrangler SUV.

Trade dress consists of the unique features that distinguish a product and is generally accepted by the public as having been identified with that product. FCA, for example, sees the boxy body form of the Jeep Wrangler, front grille and round headlights as distinct from the model. The order is automatically effective but the U.S. Trade Representative has 60 days for policy reasons to potentially disapprove. The ITC, which originally began its investigation in September 2018, has since last November been evaluating the original decision of an administrative law judge. The outbreak of coronavirus postponed ITC announcement.

Mahindra said in a statement on Friday that the vehicle subject to the ITC action is no longer in production and the 2020 design was refreshed.

“The company and Mahindra Automotive North America … remain resolute in its position that the Roxor does not dilute or violate Jeep’s trade dress,” Mahindra said, adding it was weighing options with respect to an appeal during the review period or in federal appeals court.

FCA said in a statement it was pleased with the decision and that the Italian-American automaker reserved further comment while it studied the ruling.

The Roxor is assembled in Auburn Hills, north of Detroit. Mahindra on Friday reported a quarterly loss and was pushing to cut costs during the outbreak.

This develops in you an inquisitive nature and you start to see mysteries in everyday things around you. You try to question the existence of some things and the non-existence of others. In this world full of mysteries, one such mystery is that of the Bermuda Triangle.

Also known as the Devil’s Triangle, the Bermuda Triangle is a section of the Atlantic Ocean, roughly bounded by Miami, Bermuda, and Puerto Rico. Mythical literature revels in the stories of ghost ships, of airplanes disappearing forever, and of instruments going haywire around the Bermuda Triangle. But these are just fanciful theories; there is no solid proof that these types of mysterious disappearances occur less in the other well-traveled sections of the ocean than they do in the Bermuda Triangle. As a matter of fact, there are many people who navigate the Bermuda Triangle on a daily basis without any incident. So why do we still think of Bermuda Triangle as an unsolved mystery?

Covering about 500,000 square miles of the ocean, the area was sailed through by Christopher Columbus on his first voyage. He reported that a great flame of fire crashed into the sea which was probably a meteor. Also, his observations about the erratic compass readings could be explained by the fact that at that time a sliver of the Bermuda Triangle was one of the few places on earth where the true north and the magnetic north aligned together.

Reports of unexplained disappearances started capturing people’s interest around the early twentieth century when the USS Cyclops, a 542-meter long navy ship with 300 men and thousands of ton of manganese onboard, sank somewhere between Barbados and the Chesapeake Bay in 1918. Although they were equipped to do so, the Cyclops never sent an SOS distress call and the extensive search yielded no wreckage.

After that, an alleged pattern started to form when five navy bombers carrying 14 got severely lost in the area in 1945. The nave bombers were forced to ditch at sea when they ran low on fuel. A rescue plane with 13 men also disappeared while searching for them. Even a weeks-long investigation failed to turn up any evidence.

Bullying is unwanted, aggressive behavior among school aged children that involves a real or perceived power imbalance. The behavior is repeated, or has the potential to be repeated, over time. Both kids who are bullied and who bully others may have serious, lasting problems. Bullying includes actions such as making threats, spreading rumors, attacking someone physically or verbally, and excluding someone from a group on purpose. In some way or the other almost everyone of us has undergone bullying. A major question to be asked is that, Due to what reasons do people bully?

Bullying is of various kinds such as verbal, social, and physical bullying. And now another dimension is added to the list called cyber bullying. Bullying can occur during or after school hours. While most reported bullying happens in the school building, a significant percentage also happens in places like on the playground or the bus. It can also happen travelling to or from school, in the youth’s neighborhood, or on the Internet.

Verbal Bullying:- It means writing and saying mean things about someone. It may include, teasing, name calling, inappropriate sexual comments, taunting, and threatening to cause harm.

Social Bullying:- It is also known as relational bullying, it means hurting someone’s reputation or relationships. It may include, leaving someone out on purpose, telling other children not to be friends with someone, spreading rumors about someone, and embarrassing someone in public.

Physical Bullying:- It means hurting a person’s body or possessions. It may include, hitting, kicking, pinching, spitting, tripping, pushing, taking or breaking someone’s things, and making mean or rude hand gestures.

Cyber Bullying:- It is bullying using electronic means. It is also know as online bullying. It has become increasingly common, especially among teenagers, as the digital sphere has expanded and technology has advanced.

Effects of Bullying:-

Bullying can affect everyone—those who are bullied, those who bully, and those who witness bullying. Bullying is linked to many negative outcomes including impacts on mental health, substance use, and suicide. It is important to talk to kids to determine whether bullying—or something else—is a concern. Kids who are bullied can experience negative physical, school, and mental health issues. Kids who are bullied are more likely to experience:

  • Depression and anxiety, increased feelings of sadness and loneliness, changes in sleep and eating patterns, and loss of interest in activities they used to enjoy. These issues may persist into adulthood.
  • Health complaints
  • Decreased academic achievement—GPA and standardized test scores—and school participation. They are more likely to miss, skip, or drop out of school.

A very small number of bullied children might retaliate through extremely violent measures. In 12 of 15 school shooting cases in the 1990s, the shooters had a history of being bullied.

How to manage Bullies:-

  1. Tell your parents or someone you trust about the bullying. Tell your parents the entire thing, they will surely help.
  2. Report bullying and victimization incidents to the school authorities or complain committee.
  3. Talk openly about bullying and don’t be afraid to speak up.
  4. Avoid bullies wherever you are and feel good about yourself.
  5. If someone is bullying you, don’t bully them back. Always stand tall and have composure.

How to take actions against Bullying:-

  1. Establishing an Internal Complains Committee (ICC) in every institution.
  2. Speaking up against bullying.
  3. Stay with people you trust. Avoid those places with higher risks.
  4. Getting help. Remaining quit will not help. Report as soon as possible.

Hence, bullying is wrong and will not stop. It is us who needs to stand strong against bullying, because those who judge will never understand, and those who understand will never judge.

CAN HARSHER PUNISHMENTS REDUCE CRIME RATES?

Crime is so destructive that not only the victims suffer, but the life of a criminal also undergoes tribulation, and society bears the disturbing news of witnessing it.

It appeals to think that harsh punishment can reduce crime rates. Some criminals are aware of the penalties, but they feel that they will not get caught. They believe this because our crime fighters are limited in number, so efficient vigilance is not always possible over a territory. They know that we have a delayed justice system, procedures are tedious, and thus it doesn’t inhibit wrong intentions. No lawbreaker looks in the law book for penalty or punishment. For some criminals, getting caught does not matter. Committing that particular crime is the only thing which matters to them at that time. They hear, see, feel nothing and have all their senses attached with the wrong intention. For such people, whose minds are so corrupt that there can be no reversal at all, harsh punishment is the way forward.

Some people commit crimes due to unsatisfactory conditions. If India becomes self-sufficient, these crimes will end. There are crimes which occur out of habit, for example, kleptomaniacs (habitual thieves). Such people need rehabilitation more than punishment to condition their mindset and steer it in the right direction. Still, they will get punished as it is in our system. There is varying nature of crimes, and so it cannot be generalized that only harsh punishments reduce crimes. If the justice system is prompt in serving justice, it will substantially reduce crime as it will instil fear in potential lawbreakers. Hence, possible future crimes could be curb to an extent.

We live in a civilized society, and we have a background of a culture which emphasizes the virtue of forgiveness. This virtue shows that humane methods of punishment do work in some cases. Not always do we need to resort to harsh ones. The people who turn into criminals are a part of society, and the reason to ‘why they become criminals when living in the same society’ is a matter of great concern. There must be a stress on moral education at all levels. If it is there, then perhaps crime will reduce.

Crimes cannot be forgiven, and the guilty must be punished, but it does not mean the same person will always remain a criminal. The rebellious lawbreaker inside that person must be eradicated, and a resolve to live non-violent, law-abiding life must be spurred. We must not hate the person but the filth inside the person that created a criminal. If only the person had an atmosphere where he could re-create himself into a better person, then there would be more hope. We see crimes through the eyes of hatred and often get blinded by it. Nobody is born good or bad; the upbringing, circumstance and mental conditioning make a person good or bad.

Enough has been spoken about reducing crime when we should have been making efforts to wipe out the cause that leads to the generation of the criminal mindset. In a developing country like India, millions are starving to death; many have plenty but lacks the moral sense; many think it is fun to commit a crime’ there are many who do it out of emotional outbreak. Some do it because they are situational criminals. If we believe in God, then we must believe in the law of karma. For every good, we will receive will, and for every bad, we will get the same. If we don’t believe in God, then we must believe in our consciousness; we must not think or do anything which makes us fall in our own eyes. Lastly, the solution may not lie in philosophical or even realistic discussions. But why wait for a crime to happen when we must put our energy and mind in churning out ways that eradicate the generation of thought that leads to crime. In a nutshell, harsher punishment might deter people from committing crime to a certain extent, but it is not the only solution. There are more efficient and effective ways to do so as well.

History:

The PlayStation 4 was released on November 15, 2013, in the United States and Canada, followed by further releases on November 29, 2013. It is still not officially out of market.

The PS5 design was officially revealed on June 11, 2020. It’s the 5th part to the Sony PlayStation saga and keeping in mind the epic hit of the PlayStation 4, it can be pretty well assumed that the PS5 is also going to be a big hit.  Its CPU is going to feature the AMD Zen 2-based CPU with 8 cores at 3.5 GHz. The GPU will be running at 10.28 TFLOP and the 36 CUs at 2.23 GHz. The memory interface will have a 16GB GDDR6 and the memory bandwidth will be 448GB/ s. Although Sony said that the internal storage will be 825GB SSD but as per the latest information, the PS5 will have a classic 1TB version and a premium 2TB version. So most probably the company was referring to the usable storage space on the 1TB version.

Previous rumors had pegged that the price of the PS5would be priced at $500 (roughly 37,900 rupees) in the US and the prices are expected to be higher in UK. But according to the latest updates, the PS5 is going to have a price of $760 (roughly 57,700 rupees) in the US and about €670 in UK.

Games on PS5

The new releases that are announced by Sony for the PS5 include Horizon Forbidden West, Marvel’s Spider-Man: Miles Morales, Gran Turismo 7, Ratchet and Clank: Rift Apart, Demon’s Souls, Project Athia, Returnal, Sackboy: A Big Adventure, Astro’s Playroom, Destruction AllStars and Godfal.

Third party games for PS5 include Resident Evil Village, Pragmata, Deathloop, Ghostwire: Tokyo, Little Devil Inside, NBA 2K21, Solar Ash, BugSnax, Kena – Bridge of Spirits, Goodbye Volcano High, Oddworld Soulstorm, Stray, Jett: The Far Shore, Hitman 3, Metal: Hellsinger, Chivalry 2, Paradise Lost, Dirt 5, Chorus, Madden 21, Vampire: The Masquerade – Bloodlines, Assassin’s Creed Valhalla, Observer: System Redux, The Lord of the Rings: Gollum, Outriders and WRC 9.

Special features of the PlayStation 5

  • Backwards Compatibility: In a world where Microsoft is touting backwards compatibility on their new Xbox 2/Project Scorpio system, the pressure is on for Sony to match that with the PS5. Of course, when we talk about backwards compatibility, we have to consider how far back we want. PlayStation has a lot of classic titles from PS1, PS2, and PS3. In fact, the PS4 has already racked up several titles that will no doubt be remembered fondly by history. PlayStation fans want compatibility as far back as we can get. There are so many games we want to have access to on our latest console. Sony has made some progress here with PS2 Classics on PS4, and they’ve certainly done plenty of remasters to bring games like The Last of Us and God of War III to the new console. For PS3 games, we have the streaming service known as PlayStation Now, but that’s yet another thing to pay for, and its selection is good but not overwhelmingly great. Meanwhile, Xbox players are getting more and more 360 games on their system for free if they already own it. I have to give them a point for that, because it is the right way to handle backwards compatibility. Ideally, PS5 will take this approach where you can keep the games you own and play them on the new system. Digital titles will be accessible, and physical games can be inserted to validate them and add them to your library like Xbox does.
  • Graphics Power: Any time there’s a new console, graphics are a major point of discussion. After all, power is the selling point of any next generation system. How much better will make games look and play on this system? Microsoft’s upcoming console boasts 6 teraflops of graphical power, which is above even the PS4 Pro. An analyst named Damian Thong recently weighed in and said Sony would be releasing the PS5 with 10 teraflops of power! That’s the equivalent of today’s top-shelf video cards on PC, so with another few years, that tech could reasonably find its way to consoles. With that kind of power, 4K wouldn’t be a problem. Graphics would look significantly better than they do now. Textures, lighting effects, antialiasing, 10 teraflops could do it all.
  • More Games: What do we talk about after graphics? Yep, it’s games. This feature is something that Sony has been bringing since the launch of PS4. New exclusives like Horizon: Zero Dawn, Nioh, and Persona 5 are just some of the many titles that Sony secured on their platform. With powerhouse developments like Guerilla Games, Naughty Dog, and Sucker Punch, Sony has no problems with their lineup. If anything, it’s the launch titles that will require special attention. Coming out of the gate strong is important, and that’s what I believe gamers want to see from this specific feature.
  • Processing power: All too often, this gets lumped in with graphics, but they’re two very different things. Graphics processing handles the way the game looks and the resolution. The CPU and RAM are the ones who put it into motion and calculate all those mathematical equations to make the game run. Without a powerful processor to back it up, the graphics could look as good as they want, but the frame rate would be slow and sluggish. You need both to make the machine run well. Of course, PlayStation’s architect, Mark Cerny, knows all about this, so I have faith he will bring the heat with PS5.
  • Hard Drive Space/Speed: With the release of the PS4, we saw games that were 50+ gigabytes in size for the first time on consoles. Even with the 500GB drives that came out, they filled up fast! Thankfully, not every game is that big, but my PS4 Pro’s 1TB of space went pretty quickly despite being double the size. PS5 should, at the very least, have a 1TB hard drive, but I would argue that 2TB is more of a sweet spot for hardcore gamers. Now, the speed of the hard drive matters as well. If Sony were to opt for a SSD inside the PS5, it would drive up costs. The trade-off, of course, would be faster loading times, but you pay more per gigabyte on a hard drive like that. I’m not too worried about the type of drive, more so the space. That being said, SSDs are more reliable, so I think we would certainly welcome the option.
  • Virtual Reality: Virtual reality is still a toddler in the realm of technology. There’s a lot of argument as to whether VR will take off, but I’m convinced that Sony has found the sweet spot this time. Bringing the Move controller back was a smart move, and incorporating the camera created a trifecta of peripherals that all suddenly found purpose. VR is one of those things that you won’t believe until you try it. Naysayers are often the very same people who have never experienced it. We’re confident Sony will win the VR war with their PlayStation VR headset and its successor on PS5.
  • Console Design: You know, console design isn’t a make-or-break scenario, but it does help to have a sexy looking system in your entertainment center. The PS4’s design was pretty sleek and, while the PS4 Pro has been compared to a Big Mac in its triple layered design, I still dig that model as well. Honestly, I would mind a glossy finish on the PS5. Bring back some of the style that the PS3 had, which of course was also compared to a George Foreman grill when it first released. People will always have their laugh, but I think a striking design with a glossy finish would be sweet for PS5.
  • Controller design: The design of the controller would be more important for me. This is an important feature. The DualShock 4 is perhaps the pinnacle of controller design, but we all like new things. I think Sony will try to one-up themselves again with the PS5’s controller. They’ll keep the basic layout the same (or risk riots), and add something new. This time around, we got the touch pad, and the lightbar. What’s next? Time will tell.
