Employees Cannot Be Fired Merely For Being Homosexual Or Transgender

In a remarkable and righteous decision, the US Supreme Court in Gerald Lynn Bostock Vs Clayton County, Georgia which is Certiorari To The United States Court Of Appeals For The Eleventh Circuit No. 17-1618 and which was delivered on June 15, 2020, has laid down cogently, clearly and convincingly that employees cannot be fired from the jobs merely because of their transgender and homosexual identity. It also lays down in simple and straight language that, “An employer who fires an individual merely for being gay or transgender defies the law.” Very rightly so!

                                            To put things in perspective, the majority judgment was authored by Justice Neil McGill Gorsuch in which Roberts, C.J., and Ginsburg, Breyer, Sotomayor and Kayan, J.J. joined. But Justices Alito, Thomas and Kavanaugh dissented. The Court by a 6-3 majority held that Civil Rights Act of 1964 prohibiting workplace discrimination on the basis of sex also protects employees based on their sexual orientation or gender identity. It must be mentioned here that the Civil Rights Act explicitly prohibits discrimination of any kind in the workplace on the basis of race, colour, religion, sex or national origin.

                                       Be it noted, in this case which arises out of a petition filed by Bostock who is a long-time employee was allegedly fired by his employer simply for being homosexual or transgender. The issue that was considered by the Court was whether the Act prohibits discrimination on the ground of sexual orientation or gender identity? This key issue was examined in detail by the US Supreme Court.   

                                     To start with, it is first and foremost most explicitly stated at the outset that, “Sometimes small gestures can have unexpected consequences. Major initiatives practically guarantee them. In our time, few pieces of federal legislation rank in significance with the Civil Rights Act of 1964. There, in Title VII, Congress outlawed discrimination in the workplace on the basis of race, color, religion, sex or national origin. Today, we must decide whether an employer can fire someone simply for being homosexual or transgender. The answer is clear. An employer who fires an individual for being homosexual or transgender fires that person for traits or actions it would not have questioned in members of a different sex. Sex plays a necessary and undisguisable role in the decision, exactly what Title VII forbids.”

                                 As it turned out, it is then clarified in the next para that, “Few facts are needed to appreciate the legal question we face. Each of the three cases before us started the same way: An employer fired a long-time employee shortly after the employee revealed that he or she is homosexual or transgender – and allegedly for no reason other than the employee’s homosexuality or transgender status.”

                                             To say the least, it is then mentioned in this judgment about the different cases of discrimination that, “Gerald Bostock worked for Clayton County, Georgia, as a child welfare advocate. Under his leadership, the county won national awards for its work. After a decade with the county, Mr. Bostock began participating in a gay recreational softball league. Not long after that, influential members of the community allegedly made disparaging comments about Mr. Bostock’s sexual orientation and participation in the league. Soon, he was fired for conduct “unbecoming” a county employee. Donald Zarda worked as a skydiving instructor at Altitude Express in New York. After several seasons with the company, Mr. Zarda mentioned that he was gay and, days later, was fired.”

                            While continuing in the same vein, it is then envisaged that, “Aimee Stephens worked at R.G. & G.R. Harris Funeral Homes in Garden City, Michigan. When she got the job, Ms. Stephens presented as a male. But two years into her service with the company, she began treatment for despair and loneliness. Ultimately, clinicians diagnosed her with gender dysphoria and recommended that she begin living as a woman. In her sixth year with the company, Ms. Stephens wrote a letter to her employer explaining that she planned to “live and work full-time as a woman” after she returned from an upcoming vacation. The funeral home fired her before she left telling her “this is not going to work out”.”

                               Importantly, the next important point that must be stated here of this notable judgment is this: “From the ordinary public meaning of the statute’s language at the time of the law’s adoption, a straight forward rule emerges: An employer violates Title VII when it intentionally fires an individual employee based in part on sex. It doesn’t matter if other factors besides the plaintiff’s sex contributed to the decision. And it doesn’t matter if the employer treated women as a group the same when compared to men as a group. If the employer intentionally relies in part on an individual employee’s sex when deciding to discharge the employee – put differently, if changing the employee’s sex would have yielded a different choice by the employer – a statutory violation has occurred. Title VII’s message is “simple but momentous”: An individual employee’s sex is “not relevant to the selection, evaluation, or compensation of employees.” Price Waterhouse v. Hopkins, 490 U.S. 228, 239 (1989) (plurality opinion).”

                                            More importantly, it is then rightly stated next in this commendable judgment that, “The statute’s message for our cases is equally simple and momentous: An individual’s homosexuality or transgender status is not relevant to employment decisions. That’s because it is impossible to discriminate against a person for being homosexual or transgender without discriminating against that individual based on sex. Consider, for example, an employer with two employees, both of whom are attracted to men. The two individuals are, to the employer’s mind, materially identical in all respects, except that one is a man and the other a woman. If the employer fires the male employee for no reason other than the fact he is attracted to men, the employer discriminates against him for traits or actions it tolerates in his female colleague. Put differently, the employer intentionally singles out an employee to fire based in part on the employee’s sex, and the affected employee’s sex is a but-for cause of his discharge. Or taken an employer who fires a transgender person who was identified as a male at birth but who now identifies as a female. If the employer retains an otherwise identical employee who was identified as female at birth, the employer intentionally penalizes a person identified as male at birth for traits or actions that it tolerates in an employee identified as female at birth. Again the individual employee’s sex plays an unmistakable and impermissible role in the discharge decision.”

                          Equally importantly, it is then also held that, “When an employer fires an employee for being homosexual or transgender, it necessarily and intentionally discriminates against that individual in part because of sex. And that is all Title VII has ever demanded to establish liability. An employer who fires an individual for being homosexual or transgender fires that person for traits or actions it would not have questioned in members of a different sex. Sex plays a necessary and undisguisable role in the decision, exactly what Title VII forbids. An employer who fires a woman, Hannah, because she is insufficiently feminine and also fires a man, Bob, for being insufficiently masculine may treat men and women as groups more or less equally. But in both cases the employer fires an individual in part because of sex. Instead of avoiding Title VII exposure, this employer doubles it.”  

                                        Most importantly, in the concluding part, it is very rightly underscored that, “Ours is a society of written laws. Judges are not free to overlook plain statutory commands on the strength of nothing more than suppositions about intentions or guesswork about expectations. In Title VII, Congress adopted broad language making it illegal for an employer to rely on an employee’s sex when deciding to fire that employee. We do not hesitate to recognize today a necessary consequence of that legislative choice: An employer who fires an individual merely for being gay or transgender defies the law.”

                                                No doubt, the US Supreme Court by this latest, landmark and extremely laudable judgment has prima facie made it absolutely clear that employees cannot be fired merely for being homosexual or transgender. All the employers must always adhere to this extremely commendable judgment in totality. The employers must refrain from indulging in discrimination against any employee just for being homosexual or transgender as it has got just nothing to do with the job at hand and every person has a right to be either homosexual or transgender and no one can have an unfettered right to interfere in that! There can be no denying or disputing it!

Humans have been challenging their boundaries and bringing every aspect of their dreams to be a realty. With the development in science and technology, men has been able to bring all sorts of comforts, facilities and knowledge to their lives. World war 2 led an important role in development of aerospace and related field. More aircrafts be it passenger or fighter were manufactured and this leads to a whole new phase of possibilities for humans. So humans were able to launch their first satellite in space, followed by the first person in space and then soon after a few years we were even able to land on the moon. Space became a fight between the top countries like the USA and Soviet Union. But initially Soviet Union were way long heading in this fight till the USA didn’t land their mission or manned mission on the moon. 

But the main thing to notice is that humans last landed on the moon in early 70’s.One after another space mission, Helped humans to discover a lot more about space, and each time they land, created history. But what led to the stopping of these missions suddenly. Why did the US stop their successful series of aircraft in outer space? Initially these were very successful missions to space until Apollo-13 which got to space and orbited the moon, but couldn’t land due to lack of oxygen . It was a tough journey back to planet safe, but it really helped NASA especially to look after loophole and prepare best for the next mission. After that, successful 4 missions held. But soon it stopped. The study shows the effect of “Budget for these space agencies as by the government”. In late 50’s as soon as Soviet Union started their missions to space, it put pressure on USA. Soon after they sent their first Cosmonaut to space and ended more pressure on the USA. The US seemed to lose this race to space. So they invested most of their money in developing space technology, research and new ideas to overcome this defeat. This truly resulted  as an advancement for humans and their reach beyond limits which they thought were impossible not. The moon landing and consecutive space flights lead them way long to head to Soviet Union and any other countries, making it the only country to land on the moon. 

But significantly the USA has limited its investment in most space projects and this has significantly called off most of their space missions. After 1973 , investment got less and decreased with time and is still very less as compared to what it used to be. The  reason for this is that they seem themselves as superpowers and no other country has achieved such accomplishment in space. So space travel and especially landing on the moon decreased . 

NASA is planning their next space manned program to land on the moon by 2024 and this might be a beginning of another phase of moon landing with back to back space flights and landing missions on moons. The dream to have a human base may get another lifeline to be fulfilled soon  and we may see other better possibilities, research and hidden secrets on the moon which could help us to better understand it, and we can make a permanent human base on our natural satellites.

Physicists spot a new class of neutrinos from the sun

Neutrinos from the sun’s second-most prominent nuclear fusion process have been spotted in the Borexino detector (inside shown with light-detecting sensors).

Neutrinos spit out by the main processes that power the sun are finally accounted for, physicists report.

Similar to an electron a Neutrino is a subatomic particle but Unlike an electron, it has no electrical charge. The mass of a neutrino is also very small, which might be even zero.

Neutrinos are one of the most abundant subatomic particles in the universe because they don’t have much interaction with the matters.

Two sets of nuclear fusion reactions predominate in the sun’s core and both produce the lightweight subatomic particles in abundance.

Scientists had previously detected neutrinos from the most prevalent process. Now, for the first time, neutrinos from the second set of reactions have been spotted, researchers with the Borexino experiment said June 23 in a talk at the Neutrinos 2020 virtual meeting.

“With this outcome, Borexino has completely unraveled the two processes powering the sun,” said physicist Gioacchino Ranucci of Italy’s National Institute for Nuclear Physics in Milan.

In the sun’s core, hydrogen fuses into helium in two ways. One, known as the proton-proton chain, is the source of about 99 percent of the star’s energy. The other group of fusion reactions is the CNO cycle, for carbon, nitrogen, and oxygen — elements that allow the reactions to proceed. Borexino had previously spotted neutrinos from the proton-proton chain. But until now, neutrinos from the CNO cycle were MIA.

“They’re top of everybody’s list to try and identify and to spot,” says physicist Malcolm Fairbairn of King’s College London. “Now they think they’ve spotted them, which is a major achievement, really an extremely difficult measurement to make.”

Located deep underground at the Gran Sasso National Laboratory in Italy, Borexino searches for flashes of light produced as neutrinos knock into electrons in a large vat of liquid. Researchers have spent years fine-tuning the experiment to detect the elusive neutrinos that herald the CNO cycle. Although difficult to observe, the particles are plentiful, Borexino confirmed. On Earth, around 700 million neutrinos from the sun’s CNO cycle pass through a square centimeter each second, the researchers report.

The result, presented for the first time at the virtual meeting, must still clear the hurdle of peer review in a scientific journal before it is fully official.

The property that reveals the abundance of elements present in an object that are heavier than hydrogen and helium is known as Metallicity property. Studying these particles could help reveal how much of the sun is composed of elements heavier than hydrogen and helium. That’s because the rate at which CNO cycle neutrinos are produced depends on the sun’s content of carbon, nitrogen, and oxygen. Different types of measurements currently disagree about the sun’s metallicity, with one technique suggesting higher metallicity than another.

In the future, more sensitive measurements of CNO neutrinos could help scientists disentangle the problem.

The CNO cycle is even more important in stars heavier than the sun, where it is the main fusion process. Studying this cycle in the sun can help physicists understand the inner workings of other stars, says Zara Bagdasarian, a physicist at the University of California, Berkeley, and a member of the Borexino Collaboration. “It’s very important for us to understand how the sun works.”

CHITRA, WHY DID YOU PAY MY HOTEL BILL? 🥰

The ticket collector came in and started checking people’s tickets. Suddenly, he looked in my direction and asked, ‘What about your ticket?”Not you, madam, the girl hiding below your berth. Hey, come out, where is your ticket?’ Someone was sitting below my berth. When the collector yelled at her, the girl came out of hiding.She was thin, dark, scared and looked like she had been crying profusely. She must have been about 13 or 14 years old. She had uncombed hair and was dressed in a torn skirt and blouse. She was trembling and folded both her hands. The collector started forcibly pulling her out from the compartment. Suddenly, I had a strange feeling. I stood up and called out to the collector. ‘Sir, I will pay for her ticket,’ I said.Then he looked at me and said, ‘Madam, if you give her ten rupees, she will be much happier with that than with the ticket.’I did not listen to him. I told the collector to give me a ticket to the last destination, Bangalore, so that the girl could get down wherever she wanted.Slowly, she started talking. She told me that her name was Chitra. She lived in a village near Bidar. Her father was a coolie and she had lost her mother at birth. Her father had remarried and had two sons with her stepmother. But a few months ago, her father died. Her stepmother started beating her often and did not give her food. She did not have anybody to support her so she left home in search of something better.By this time, the train had reached Bangalore. I said goodbye to Chitra and got down from the train. My driver came and picked up my bags. I felt someone watching me. When I turned back, Chitra was standing there and looking at me with sad eyes. But there was nothing more that I could do. I had paid her ticket out of compassion but I had never thought that she was going to be my responsibility!I told her to get into my car. My driver looked at the girl curiously. I told him to take us to my friend Ram’s place. Ram ran separate shelter homes for boys and girls. We at the Infosys Foundation supported him financially. I thought Chitra could stay there for some time and then we could talk about her future.Ram suggested that Chitra could go to a high school nearby. I said that I would sponsor her expenses. I left the shelter knowing that Chitra had found a home and a new direction in her life.I always enquired about Chitra’s well-being over the phone. She was studying well and her progress was good.. I offered to sponsor her college studies if she wanted to continue studying. But she said, ‘No, Akka. I have talked to my friends and made up my mind. I would do my diploma in computer science so that I can immediately get a job after 3 years.’ She wanted to become economically independent as soon as possible. Chitra obtained her diploma & got a job in a software company as an assistant testing engineer. When she got her first salary, she came to my office with a sari and a box of sweets.One day, I got a call from Chitra. She was very happy. ‘Akka, my company is sending me to USA! I wanted to meet you and take your blessings but you are not here in Bangalore.’Years passed. Occasionally, I received an e-mail from Chitra. She was doing very well in her career. She was posted across several cities in USA and was enjoying life. I silently prayed that she should always be happy wherever she was.Years later, I was invited to deliver a lecture in San Francisco for Kannada Koota, an organization where families who speak Kannada meet and organize events. The lecture was in a convention hall of a hotel and I decided to stay at the same hotel. After the lecture, I was planning to leave for the airport. When I checked out of the hotel room and went to the reception counter to pay the bill, the receptionist said, ‘Ma’am, you don’t need to pay us anything. The lady over there has already settled your bill. She must know you pretty well.’ I turned around and found Chitra there.She was standing with a young white man and wore a beautiful sari. She was looking very pretty with short hair. Her dark eyes were beaming with happiness and pride. As soon as she saw me, she gave me a brilliant smile, hugged me and touched my feet. I was overwhelmed with joy and did not know what to say. I was very happy to see the way things had turned out for Chitra. But I came back to my original question. ‘Chitra, why did you pay my hotel bill? SAY NO TO DRUGS

On International Day Against Drug Abuse and Illicit Trafficking, we should be more serious about this hazard, that destroys the lives of millions including youngsters.the theme for this year’s anti-drug abuse day Is “Better Knowledge for Better Care”. The main idea behind this theme is to stress upon the need of improving the understanding of the world drug problem.

The day is also marked as an expression of its determination to strengthen action as well as cooperation and achieve the society which is free of drug abuse.Around 35.6 million people across the world are victims of drug abuse, according to the World Drug Report 2020 published by the UN Office on Drugs and Crime. Young adults and teenagers account for the largest share of those using drugs and most of them suffer from HIV, Hepatitis C and other related diseases. Only one out of eight people who need treatment and rehabilitation are able to get it, according to the report.

So many people want to quit but they can’t due to lack of awareness and social stigma. We need to take a step to secure our life and future, this is our responsibility being a citizen of a country .
